I think I was mistaken about being fired upon when using my personal colors. I got fired upon when using British, and then one time I must have tried personal colors and got fired upon by the French ships and thought it was the fort. I replayed from the beginning and left under my own colors and only the French ships fired at me. So I think your code is working as expected.
I like the idea of spawning some British ships for the French to battle. It seems more realistic that there would be some British ships in the harbor to defend the port at the time. Plus, it would make it more like the video clip that gets played. Also, it might have the useful side-effect of keeping the French busy while your lugger sneaks away.
I'm not sure how the game works. If an enemy is engaged and you show up on the scene, will they make you the primary target? Or will they finish with who they were fighting first and then come after you? I know in many games that the player you are controlling always gets priority for AI enemies no matter how many other AI enemies may have been attacking them first.
