I just noticed that the following of our videos has an ADVERTISEMENT in front of it! *shudders*


If I understand correctly, videos should only get advertisement IF either the channel owner himself or someone with a copyright claim wants to "monetise" it.
We definitely do NOT deliberately monetize the video and the music is all original by @Flannery, so this had me quite surprised.

Yes, it does feature the "Childgrove" melody. Which stems from 1701!
I sincerely doubt that any "copyright owner" still exists who has any rights to making money from its use, so I reckon this should fall squarely in the "public domain".

If it does contain any copyrighted material, that copyright belongs to @Flannery and not anyone else.
Which means that if anyone should be making money from it, it should be him.
 
I have had disputes filed on almost every video I have ever posted. Even got two disputes on the weather video because of the sound of wind..... not even kidding, it was the sound of wind that they were trying to claim. These claims are fully automated and a person has not actually done anything in the process yet. You can dispute it, after which they will 'review' it (a fully automated process in which the claimant NEVER actually looks at the dispute) and will file a claim again, you can then dispute a second time and at that point they are required to file a DMCA takedown or file a suit in court. Statistically, it never comes to that unless they have a real claim because at that point it leaves the automated process and a person has to actually quantify the takedown. Essentially the whole process is a scam in which the claimant gets to take what clicks and ads they showed while there was a claim in progress. Last I heard it was supposed to be changing, but I will only believe it when I see it. It is a broken system and is rife with abuse.

And you are right - Childgrove does indeed no-longer have any copyrights to it, so the only Copyright in the piece falls to me as the composer of the arrangement.

It is purely a small part of Childgrove's melody that have been borrowed, the rest is far from how the original sounds and all my work :doff

I have now officially disputed the claim, which means the advertisements should be gone again.
And they'll remain gone, unless whoever thinks holds a copyright claim decides to dispute my dispute.... :rofl

Since this seems like an obviously invalid claim, I wonder if YouTube will force the "so-called copyright owners" to pay back the money they got from those YouTube ads.
If my dispute isn't disputed, that basically means that we were indeed right. In that case, should that money not be given to YOU instead?
Can we sue them and tell them to give that money back PLUS pay for the lawyer costs? :razz
 
Hehehe... I highly doubt it would ever come to that, nor that there is any money there. But I guess we will just see what comes out of it.

I am REALLY surprised it only took one dispute. So far on every claim I have had to reach the point of the second dispute and threat of a DMCA claim before they drop it. GradeAUnderA did a couple of videos about copyright claims and there are a couple on how the system works (or doesn't) and how much money people can make on copyright claims alone even when they are eventually proven false. Since there is no repercussion for a false claim, it is all a matter of bulk claims and farming those hits and ads while the video is under dispute.

I wonder if somebody is deliberately spamming certain threads.
I also wonder if that person is aware of how easy it is to deal with spam.
Doesn't seem worth the effort to me. But then.... I'm not a spammer! :cheeky
