I think it has something to do with what storyline you are playing. I played Brock/Brin the first time and they were there, and then I did Mings/Brother storyline the second time and they were not.

I have the same problem. Pintel isn't there and nothing in the forums seems to help. Looks like I have to start all over again. :'(
I saved right after I talked to Barbossa in Tortuga tavern and he said we need to hire Pintel and Raghetti. No matter how many times I re load my game, Pintel is still missing. This sucks. It looks like I have to start over.
I had just gotten the black pearl too. -
