Can anyone find a single original copy of PotC anymore?

I might cause NSA, CIA or FBI and maybe KGB to look our way by saying this lol, but while explaining a moddb.com member that our mod New Horizons is released, available and free..it stroke me that the original title, the backbone of the mod..is' nt! He did find a copy on a BitTorrentm, though.

Can anyone find one decent, original copy of Pirates of the Caribbean in their native country anymore? (I've found plenty on the shelves here, carrying both title and looks. But a closer look reveals the disappointing cover from the Disney-series).
 
We were actually discussing this in another thread (not accessible for all forum members) a month ago or so.
About 1,5 year ago, the game was so old that you could pick it up very cheap.
However, now the game is so old that you can hardly pick it up anymore at all.

This is, of course, NOT good for our modpack, since it still relies on the original game.
So either we make the game available for free (not quite legal), "they" make the game available again or we port to AoP/CoAS.
I strongly suspect that we'll end up going with the third option eventually, but I have no idea when.
Personally I'd opt for AFTER the release of Build 14.

In any case seeing as caribbean tales was as stable as alpha 8 i hope youll stick tho this game for a while ^^

Well, for an old game, PotC is certainly more well-represented on the torrent-sites than i expected. Most of them actually come with the Build_13 and even alpha 8 (although with poor filestructure and instructions).

I totally agree with you on the "questionable ethics"-issue, we can' t release a pirated(<sup><sub><!--sizeo:1--><span style="font-size:8pt;line-height:100%"><!--/sizeo-->hoho<!--sizec--></span><!--/sizec--></sub></sup>) version. But even if we are able to port the Build Mod to CoAS, it will still take months or years to do so..

I could contact BethesdaSoft (they are still alive and kicking with the recent releases of the Fallout and the Oblivion series) and ask, if they have any plans of releasing PotC again?

Also, would BethesdaSoft (as the publisher) maintain the copyrights or would it still be Akella? I am not that into legal issues around computergames, but you know, I could additionally suggest BS making PotC open-source as well? Or would that be totally nuts?
 
You might start out with asking seaward.ru what they know about the legal issues concerned with making the game more widely available.
You already established contact with them, so I'm hoping there's a good chance of good information coming from there.

How can disney have any stake in it since its only the name thats the same with the movies. Well and 1 ship. The storyline and characters are totally different.

I get the game if i want every time on ebay Germany. In the next time a buy once again, because I found new friend who wants to play this game. So, if you want I buy one for you and send it, no problem. It´s up from 1€ to maybe 7 or 8€ plus shipping. AoP also no problem as original by the same price.

They might hold the rights to it, or something. There was someone a while back from here (no, I'm not saying who it was) who uploaded the stock game, Build 13, and some extra ships in a zip file on the Pirate Bay, and added a link to the site in the comments section for the torrent. I'm sure Disney would go bonkers though if PA started distributing the stock game for free. <img src="style_emoticons/<#EMO_DIR#>/laugh.gif" style="vertical-align:middle" emoid="xD:" border="0" alt="laugh.gif" />

Both E-Bay and Amazon just seem to have the DVD case edition of the game, or used copies of the original minus both the box and paper manual. Quite likely that half of them are bootlegged copies now, though - I just discovered that's what the copy I bought is. The stinking disc label on CD2 peeled off, and low and behold, it's a Maxell CD-R. <img src="style_emoticons/<#EMO_DIR#>/modding.gif" style="vertical-align:middle" emoid=":modding" border="0" alt="modding.gif" />
 
Well if the game isnt sold anywhere anymore i think it wouldnt be a problem buisness whise to make it opensource.

Then again the AOP games use the same engine >.<
 
That's quite impressive that they're bootlegging copies of an unsuccesful and buggy obscure game that was unfinished and hyjacked as a movie tie-in!

AoP uses almost the same engine, yes, but doesn't have the content.

I wonder... if we DO port to CoAS, wouldn't we need to lose all PotC locations and such because of copyright issues?

Anyway, Disney contacted Akella, so I imagine that Akella *might* be able to contact Disney as well.

Dont they have a public relations branch.

Heck mods bring games to life. Just look what happened to Counter Strike ^^;

Thank you, Keith. If you already tried with Bethsoft, its no bother. You are probably right about Disney. Also, they have those lawyers who "foxed" every moddingteam, trying to make something out of their pile of © and (<sup>TM</sup>)´s, they could also stop this mod. ("getting Fox'ed" refers to a case where a guy was trying to make a (free) StarWars-mod for Quake, he had a giant lawsuit from Fox Entertainment "making an example" towards others modders, should they get similar ideas..) But as we never did anything wrong and Disney is one massive bulkcarrier of unstoppable staff, they just might have the time to reply me as well! I´ll give it a try..

They can, if they bought the concept from the author either outsourced the work or completely bought the game from Akella.

Yes. And then i´ll try to track down some legal division at Disney if it turns out, Akella has no legal copyrights.
The head of Akella is Dmitri Arkhipov and i believe, i was only able to reach him out of pure luck, because of my switch to a gmail-account. Google might not be filtered like private european domains are. Dont bother contacting Akella´s PR-woman, I only got an auto-reply in russian <img src="style_emoticons/<#EMO_DIR#>/smile.gif" style="vertical-align:middle" emoid=":)" border="0" alt="smile.gif" />
 
Ahh I should have said "no reply"

Also, Disney contacted Bethsoft who in turn changed the focus to POTC away from SD2 (In theory it was going to be a 100% success considering the fill tie in so it's understandable, as Bethsoft owned the rights to SD2 Akella would had little choice and considering the potential windfall may have gone along with it) So while Bethsoft own the IP of the game Disney has rights to the name and any references to any of their IP. Meaning if Bethsoft were to release it they would have to strip away the characters, the 1 ship and change the name of the game. Which I would imagine for a 5 year old game with extremely limited sales potential is too much trouble to do.

So I think the possibility of getting POTC out legitimately is almost 0% you have to get it via ebay as Shalke suggested or find some dodgy way to get it.
